Railroad Workers - What to do if you are Injured on the Job
If you are injured while working on a railroad there are several things that you need to do before consulting a lawyer.
First and foremost – get medical attention immediately following your injury. You should also inform your supervisor immediately and fill out an accident report. Be sure to read the report very carefully before you sign anything. Also, be sure to get a copy of your accident report.
After these immediate steps, report the accident to your railroad union representative as soon as you are able. You should take pictures of your injuries and get names of any witnesses or people who knew about any defective equipment or hazardous conditions. Make this detailed personal report so that you can have it when you contact a lawyer about your injuries.
Make sure to keep a record of time that you were not able to work due to your injuries. You can contact the Railroad Retirement Board to discuss sickness benefits. Contact your insurance company if you have disability insurance.
Taking these steps helps in the future, should you decide to seek legal assistance for your railroad injuries.
Things NOT to do When Injured
When you are receiving medical attention, don't let any railroad officials stay with you as you are treated. You don't want anything said during that time to be used against you.
Don't sign any statements other than the accident report. The written accident report should be the only statement you make about your injuries. Don't give any other statements (written or recorded) about your injuries until you discuss things with union officials and your FELA lawyer.
When you are filling out the accident report – don't answer "no" to any questions on the report that talk about equipment defects. Leave investigators to decide whether or not there were defects in equipment when you were injured.
